A tanked-up mum kicked another woman in the head during a boozy row over a cigarette.
Kelly Edgecumbe, 25, was spared jail for the “vicious” assault when a judge ruled that locking her up would see her miss the first months of her newborn’s life.
Hull Crown Court heard how Edgecumbe got into an argument over a cigarette with another woman and her partner Jamie Foston.
HullLive told how prosecuting barrister Phillip Evans said: "There was an argument with Ms Edgecumbe in the beer garden over a cigarette which got intense.
"Ms Edgecumbe demanded an apology from Mr Foston over his remarks during the course of the argument."
This continued into the pub lobby where Edgecumbe “struck out” at Foston who retaliated by punching her.
Foston fled the pub but walked back in after forgetting his glasses –returning as Edgecumbe left the building.
The pair screamed at each other before Edgecumbe tore his shirt and kicked his partner “with some force” in the head.
Mr Evans told the court: “She [Foston’s girlfriend] says as a result of the incident she is receiving counselling for that and for a family bereavement. She has been prescribed anti-depressants.
“She has only been in the city centre a couple of times since the incident. She has not been out socialising and has not drank alcohol since.”
Edgecumbe pleaded guilty to assault occasioning actual bodily harm. Foston also appeared alongside her in court after pleading guilty to affray.
Judge David Tremberg said their behaviour as “disgraceful”.
“Your vicious assault of that young woman engaged the risk that she might suffer serious or fatal harm. If she had done you would now be looking at a sentence of years and years.”
“What I am about to do I am not doing it for you I am doing it for your child. You don’t deserve it.
“The court is obligated to consider the affect that immediate custody would have on your baby.
“I’m proceeding on the basis that if you were locked up today the likelihood is you would be separated from your child at a critical point in the bond between a mother and child.
“That child has done nothing to deserve that.”
